Terms of Service

These Terms of Service ("Terms") govern your use of the Nowadays iOS application ("Nowadays", "the app", "we", "our"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

The Service

Nowadays is a personal-memory iOS app that builds an on-device knowledge graph from your calendar events and photos. Core processing — calendar analysis, photo matching, and search — happens on your iPhone, and your photos, notes, and knowledge graph are stored only on your device. Two narrow exceptions exist: the optional AI features send structured event metadata through a server we operate to Anthropic's Claude API, and anonymous, opt-out usage analytics are sent to TelemetryDeck. Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use Nowadays on Apple devices that you own or control, for your personal, non-commercial use.

Restrictions

You agree not to:

Reverse-engineer, decompile, or disassemble the app, except to the extent expressly permitted by applicable law.
Modify, adapt, or create derivative works of the app.
Remove or alter any proprietary notices in the app.
Use the app to violate any law, infringe any third party's rights, or transmit harmful or unlawful content.
Attempt to extract, scrape, or replicate the app's source code or underlying models.
Use the app to access another person's calendar, photos, or accounts without their permission.

Your Account and Data

Nowadays does not require an account with us. The app may use your Apple ID (via iOS) and, optionally, your Google account (via OAuth) to read calendar data on your device.

You are responsible for:

Maintaining the security of your iPhone, Apple ID, Google account, and any API keys you provide.
The accuracy and lawfulness of the data you allow the app to access on your device.
Backing up your device. Because all Nowadays data lives on your device, deleting the app or losing your device deletes the data.

Third-Party Services

The app integrates with the following third-party services. Your use of those services is governed by their own terms:

Apple — App Store, EventKit, Photos, CoreLocation. Subject to the Apple Media Services Terms.
Google Calendar API (optional) — used only if you connect your Google account. Subject to Google's Terms of Service and the Google API Services User Data Policy, including the Limited Use requirements.
Anthropic Claude API (optional) — powers the AI features, either via the app-managed beta (routed through a server we operate on Cloudflare Workers) or directly from your device if you provide your own API key. Subject to Anthropic's Commercial Terms of Service.
Cloudflare — hosts the proxy server used by the app-managed beta AI mode. Subject to Cloudflare's Terms of Use.
TelemetryDeck — anonymous, opt-out usage analytics (see the Privacy Policy for what is sent). Subject to TelemetryDeck's Terms of Service.

We are not responsible for the availability, content, or practices of third-party services.

AI Features

Nowadays' optional AI features generate summaries and answers using the Anthropic Claude API. AI output may be inaccurate, incomplete, or biased. You are responsible for reviewing AI-generated content before relying on it for any decision.

Intellectual Property

The app, its design, source code, and all related materials are owned by New Office Works and protected by copyright, trademark, and other laws. These Terms grant you no rights to the Nowadays trademark or branding.

You retain all rights to your own content — calendar events, photos, notes, and the on-device knowledge graph derived from them. Nowadays claims no ownership of your data.

No Warranty

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected.

Limitation of Liability

To the fullest extent permitted by law, in no event will New Office Works be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, loss of profits, or loss of use, arising out of or in connection with your use of the app — even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to the app or these Terms is limited to the amount you paid us for the app in the twelve months preceding the claim, or HKD 100, whichever is greater.

Termination

You may stop using the app at any time by deleting it from your device. We may update, suspend, or discontinue the app, or any feature of it, at any time without notice. Upon termination, the licence granted in these Terms ends. Sections that by their nature should survive termination will survive.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected on this page with an updated date. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes arising out of or relating to these Terms or the app will be resolved in the courts of Hong Kong, and you consent to that jurisdiction.
